You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information during registration and keep your account information up to date.
2. Products and Services
Software Licenses
Our software products (AI Photo Booth Pro, AI Drawing Screen, Photo Mosaic Wall) are licensed, not sold. Upon purchase or subscription, we grant you a non-exclusive, non-transferable license to use the software in accordance with the applicable license terms.
Digital Products
Digital products such as face swap packs, creative add-ons, and AI credits are delivered electronically. Due to the nature of digital products, all sales of digital items are final unless otherwise stated.
Hardware Products
Photo booth hardware and kiosks are physical products subject to our shipping and return policies. Hardware warranties are provided as specified in the product documentation.
3. Subscriptions
Billing
Subscription plans are billed on a recurring basis (monthly or annually) as selected at the time of purchase. Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.
Payment
All payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on file for the recurring subscription fees. If a payment fails, we will attempt to retry the charge according to our retry schedule and may suspend your access after the grace period expires.
Cancellation
You may cancel your subscription at any time through your account dashboard. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.
Price Changes
We reserve the right to modify subscription pricing. Existing subscribers will be notified at least 30 days before any price change takes effect.
4. Acceptable Use
You agree not to:
- Use our products for any unlawful purpose
- Reverse engineer, decompile, or disassemble our software
- Share, distribute, or sublicense your account access
- Attempt to gain unauthorized access to our systems
- Use our products to create content that is illegal, harmful, or infringes on third-party rights
- Resell or redistribute our software without written authorization
5. Intellectual Property
All content, software, trademarks, and materials on our website and in our products are owned by Activation King LLC or our licensors. You may not copy, modify, distribute, or create derivative works without our express written permission.
Content generated by users using our software (photos, effects, artwork) remains the property of the respective event organizer or end user, subject to any applicable third-party license terms for AI-generated content.
6. AI and Generated Content
Our products utilize artificial intelligence for photo effects, face swaps, and image generation. You are responsible for ensuring that AI-generated content is used in compliance with applicable laws and with the consent of depicted individuals. We are not liable for misuse of AI-generated content.
7. Affiliate Program
Participation in our affiliate program is subject to separate affiliate terms. We reserve the right to modify commission rates, terminate affiliate accounts, or change program terms at any time.
8. Limitation of Liability
To the maximum extent permitted by law, Activation King LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of our products and services.
Our total liability for any claim arising from these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.
9. Disclaimer of Warranties
Our products and services are provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Indemnification
You agree to indemnify and hold harmless Activation King LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our products, violation of these Terms, or infringement of any third-party rights.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Delaware.
12. Changes to These Terms
We reserve the right to update these Terms at any time. We will notify registered users of material changes via email. Continued use of our services after changes take effect constitutes acceptance of the revised Terms.
13. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
